The Venice Commission recommends addressing the following issues as a matter of priority before the constitutional referendum:
-Ensuring that all Haitian nationals be in a position to take part in the electoral process;
-Ensuring the proper registration of voters; in particular, measures should be taken to facilitate the registration of women and young voters, as well as of displaced persons;
-Ensuring equal access to the voting process all over the territory;
-Providing for a balanced composition of the lower electoral administration with no possibility to dismiss its members at will;
-Speeding up the process of transmission and announcement of results and ensuring its transparency, if appropriate through the use of digital technologies;
-Considering the introduction of a judicial appeal, for example through the creation of an Electoral Tribunal composed of judges from other courts. If this is not possible, taking as many first instance decisions as possible at the lower levels of the electoral administration to ensure that cases are decided by two instances;
-Ensuring full access of domestic (partisan and non-partisan) and international observers to all stages of the electoral process; ensuring the training of domestic election observers;
-Ensuring limited public financing of the electoral campaign without providing incentives to the creation of parties without any real basis;
-Ensuring equal access to public media to supporters and opponents;
-Providing for effective measures towards participation of women and youth.
-Examining the possibility of introducing limited out-of-country voting and/or e-voting.
