The explanatory report on the present amendments abolishing the gender quotas refers to Article 3(4) of the Constitution, according to which “the activities of political parties shall be based on the principles of freedom, equality, transparency, and intra-party democracy”. The report goes on to state that parties should be free in the formation of candidate lists and they should have the autonomy to operate according to meritocratic principles alone. While it is not for the Venice Commission to assess the constitutionality of the now abolished gender quotas, it notes that it has been confirmed by the Constitutional Court as seen above.
