Impeachment of judges goes against European standards: the Venice Commission is therefore of the view that the members of the JNE should not be subjected to juicio politico. The Commission acknowledges, however, that impeachment of judges is an accepted feature of certain democratic systems in the Americas and is not challenged as such in Peru. The Commission is of the view that at any rate and at the very least, to align with the standards of independence of the judiciary certain guarantees should be provided (see below).
