Section 38.

The main question in a procedure on the invalidation of elections is under what conditions such an invalidation should be allowed. It is therefore necessary to determine whether the integrity of the election has been irreparably damaged, i.e. whether it is damaged in such a way that it cannot be restored. The consequence would then have to be that the only remedy is a repetition of the elections (even if it is never a real “repetition” as it will always take place under changed circumstances).
