This basic principle raises several questions: how can it be established that irregularities may have affected the outcome of elections, what is the required level and burden of proof? What is the threshold for concluding on “a genuine prejudice to the outcome of the election” which justifies its invalidation? Neither international standards nor national practice give common and precise answers to those questions, but they provide some elements to be taken into account.
