If the term of office of a deputy expires, unless he resigned earlier than within six months of the confirmation of the mandate, the candidate from the same list of candidates who would have been elected if the deputy whose mandate had expired had not been elected becomes the deputy for the remainder of the mandate period.

If the candidate from the previous paragraph does not announce that he accepts the mandate within eight days, this right is transferred to the next candidate.

By decision, the National Electoral Commission determines which candidate from the first paragraph of this article holds office for the remainder of the term of office of the National Assembly or which candidate from the second paragraph of Article 14 of the Law on Members of Parliament (Official Gazette of the Republic of Slovenia, No. 112/05 - official consolidated text, 109 /08, 39/11 and 48/12) performs the function during the time when the member of parliament holds the office of prime minister, minister or state secretary, and informs the National Assembly about this.
