Registration of council members and commencement of their term of authority
(1) The rural municipality or city electoral committee registers, by a resolution, the elected council membersafter the election day where the term for filing complaints or appeals with the National Electoral Committee and the Supreme Court has expired or where final resolutions have been adopted in respect of such complaints and appeals.
(2) In the event prescribed in § 67 of this Act, the rural municipality or city electoral committee registers, by aresolution, the elected council members after the day of the repeat vote, taking into consideration the provisions of subsection 1 of this section.
(3) The election results are deemed to be declared and the term of authority of a council member commences onthe day following the publication of the resolution of the rural municipality or city electoral committee set out in subsection 1 or 2 of this section.
(31) Where an elected candidate holds an office at the time of the declaration of the election results, which is incompatible with the office of a council member, they must notify the rural municipality or city electoral committee within three working days after the day of declaration of election results, whether they wish to participate in the work of the municipal council or continue in their current office and decline the mandate. (4) The term of authority of council members elected at supplementary elections or elections of council of anew local authority in the event provided in subsection 2 of § 4 of this Act terminates at the same time as the term of authority of council members elected at the time prescribed in § 2 of this Act.
(5) The rural municipality or city electoral committee convenes the elected council not later than on the seventhday after the day of declaration of the election results. [RT I 2006, 32, 244 – entry into force 17.07.2006]
