In the context of election campaigns, disinformation in respect of migration and asylum can in fact have the effect of encouraging more or less explicit forms of incitement to hatred, especially when political communication is based on ethnic, cultural or religious generalisation attributing negative characteristics to the entire group of migrants or refugees. This can raise issues under Article 17 ECHR.
