The Venice Commission and the OSCE/ODIHR further recommend that the draft law makes a clearer distinction between private and state-owned mass media, generally referred within the law simply as “mass media”. Rules which may be effective in relation to state-owned mass media may be rather less effective when applied to mass media in private ownership. However, it is commendable that the draft law extends the principle of equal access from state owned media outlets to include private media, as long as such laws are narrowly constructed as to not impinge on freedom of expression.
