Article 67.17 bans campaigning in “the foreign mass media, which are functioning on the territory of Ukraine, and in the mass media registered in Ukraine, in which the share of foreign property exceeds fifty per cent.” This restriction implies that candidates would be barred from issuing campaign statements or advertisements aimed at Ukrainian voters residing abroad. The ability to present a candidate’s platform to voters is an inextricable part of the right to be elected. If such a provision unduly limits the ability of candidates to reach voters residing abroad, then it should be reconsidered. Such a rule would also appear to violate the citizen’s right to receive and impart information regardless of frontiers as set out in paragraph 26.1 of the OSCE Moscow Document.[8]
