In this connection, the Commission notes that by Article 7 of the Constitutional Charter of the State Union, ‘A citizen of a member state shall have equal rights and duties in the other member state as its own citizens, except for the right to vote and be elected’. In other words, the Constitutional Charter does not require equality between the political rights of Montenegrin citizens resident in Serbia and Serbian citizens resident in Montenegro.
