3. Certification of the question
 

(1) Where an initiative is obviously contrary to the constitutional purposes of the legal institution of the national referendum, or it does not comply with the conditions set out in sections 2-4, 6 and in subsection (1) of section 8, and where the signature sheet does not comply with the statutory requirements, the president of the National Election Office shall reject, by means of a resolution, the question within five days after its submission, and shall not lay it before the National Election Commission. As to the content and the publication of the resolution to reject the question, sections 46, 47, subsection (3) of section 48 and section 50 shall apply.


(2) The resolution of the president of the National Election Office shall not be subject to legal remedy – the organiser, however, can re-submit his question. Certification of the question re-submitted must be put on the agenda of the National Election Commission, except when the number of supporting electors – private individual organisers included – does not attain twenty.


(3) Where the organiser re-submits the question within fifteen days after the publication of the resolution of the president of the National Election Office to reject the question, the date of the first submission shall be considered as the date of the submission in pursuance of section 8.
